The San Francisco 49ers are about to start the season against the Green Bay Packers and just as that is about to happen on Sunday, the team received news that linebacker Aldon Smith and former tight end Delanie Walker are facing a lawsuit over an alleged shooting at a party.

According to Pro Football Talk, Smith and Walker, who is now with the Titans, are accused of shooting guns while intoxicated at a party hosted at Smith's house. The lawsuit is from a man named Ronndale Esporlas, who said he was shot at the party, which cost a cover charge of $10 and five bucks per drink and he says that the two players at the end of the party came onto a balcony and started shooting guns in the air.

The report says that Walker came to the driveway and then started shooting up in the air and at people attending the party and that caused another group to start shooting back as well. The man says that he was hit twice with bullets in the resulting crossfire and now has very bad injuries due to it. According to the lawsuit, the two players were drunk at the time and it also connects back with an incident that involved Smith when he was stabbed twice while breaking up a fight at a party. According to that previous report, two people had gunshot wounds due to that incident.

The suit comes as the team is preparing at home to play the Packers after defeating them in the playoffs last season. The stabbing report came from June of last year when he suffered injuries while trying to break up a fight and the report says that police came to break up a party late past 2 am and it also says that Smith and two people sustained gun shots wounds.
